Crash TM DEAD?!?


It was recently pointed out to me that according to tess2.uspto.gov (a database of U.S. registered trademarks) the Crash Bandicoot trademark is dead. Now this doesn't mean that Crash is dead, it just simply means his publisher's protection on his name is dead. According to it Activision hasn't payed the bill for renewing the TM in year. So, this basically means that a different publisher could make a Crash game, and Activision couldn't do a thing about it. 



However, here's the thing; The TM used for Crash's merchandise (T-shirts, costumes, action figures, etc.) and the Crash Nitro Kart TM are still listed as a live. Why is it these two trademarks are alive and not the one used for the games since 2002?

NOTE: Before I begin with my theorizing, let me make it straight. I am not a professional of trademarks laws, all I really know is stuff I've read off of ehow and couple books.

It could be Activision decided decided to save a few bucks, instead of paying two separate bills on two different trademarks titled "Crash Bandicoot" they could instead cut one off, and use the other. Before you guys start complaining that "you can't just do that! You can't add stuff to all ready existing trademarks!!" You can. Don't believe me? Just look at the page for the live TM;

On the right sides of the listed uses of this trademark it'll say "first use" and there'll be a number (19960900 for example, which means it was 1996), and the other ones have dates like 1999, three years after the trademark was registered. And if you don't believe you can add video-games to these type of TM's, just search for Shrek. You'll eventually find his TM used for about everything, including video-games (but, not the movies). But, do remember I'm no trademark lawyer, so my knowledge of this stuff is sketchy. Whatever it means, it sadly doesn't point to Sony having the rights. *sigh
